Elder Abuse
Elder Abuse is a terrible tragedy in our society. Diamond Baker Mitchell, LLP is focused on zealously asserting the rights of our clients. Elder Abuse is often thought of as physical abuse, sadly there are many other forms. Abuse can be physical, emotional, financial, caused by neglect, and invasion of one's privacy. Abuse can occur in skilled nursing facilities and other residential care facilities, or even in one's own home. The statistical prevalence of elder abuse is staggering. Recent studies have shown that 1/3 of all nursing homes have been cited for abuse violations, and a half million elders have been abused in their own homes.

We have obtained significant judgments for our clients and played a critical role in closing one facility down.

WARNING SIGNS OF NURSING HOME NEGLECT AND ABUSE
  • Poor personal hygiene, or generally unsanitary conditions of the residents or facility
  • Sudden and unexplained loss of weight
  • Malnutrition or dehydration
  • Repeated falls
  • The improper withholding of medication
  • Over-medication or the resident
  • Unexplained change in behavior, confusion or abnormal behavior (pulling out hair, rocking, etc.)
  • Signs of physical abuse such as bruises, cuts, burns or skin discoloration
  • Pressure ulcers, a.k.a. bedsores.

If you witness or suspect neglect or abuse, immediately report it to the resident's regular physician, the local Ombudsman’s office and either the Department of Health Services (for SNFs) or Department of Social Service, Community Care Licensing (for RCFEs) so that a proper investigation by trained professionals can be conducted. Time is of the essence in preventing further abuse and getting your family member or friend the care and attention they deserve.
